BRS MEDIA, INC. TRADEMARK USAGE POLICY
(Effective August 6, 2002. Revised July 1, 2023)

dotFM®, dotAM®, iRadio® and other BRS Media Inc. brands are valuable assets of the company, and are legally protected in the United States and various jurisdictions around the world. This site provides general guidelines regarding the proper, permitted and prohibited use of BRS Media trademarks. This site does not constitute a license, legal opinion, or legal advice, and is subject to change without notice. This Trademark Usage Policy will show you the proper use of BRS Media trademarks and logos. BRS Media, Inc. does require that you use our trademarks and registered trademarks correctly and refer to them properly.

USE THE CORRECT SYMBOL
When using a BRS Media trademark in text form (“BRS Media, Inc. Mark”) use the correct ® or ™ symbol, as indicated on the trademark chart below (The “BRS Media, Inc. Mark Chart”), on the most prominent (or if none is prominent, the first) appearance of a BRS Media Mark.

The basic rule is if you are using a BRS Media, Inc. Mark that is registered with the U.S. Patent & Trademark office the ® symbol should be displayed, and if the BRS Media Mark is not yet registered, the ™ symbol should be displayed. Once a BRS Media Mark is correctly attributed on a document or web page, it is not ordinarily necessary to mark subsequent appearances of the trademark in the piece. Every appearance of a BRS Media Mark in stylized form or design (“BRS Media Logo”) should also appear with the appropriate ® or ™ symbol, and may be used only under license from BRS Media, Inc.

Generally, the trademarks of BRS Media, Inc., or its subsidiaries may not be used without the express written permission of BRS Media. However, limited fair use of these trademarks (not including logos) is acceptable provided that the marks are used for the purpose of identifying or describing the company’s products and comply with the following trademark usage practice:

When using the word marks to talk about BRS Media products, include: (i) the appropriate marking symbol (e.g. ™ or ®), and (ii) the appropriate generic descriptor the first time it appears (e.g., service, website, blog).

dotAM® used to identify or describe the company’s product – .AM Top-Level Domain

dotRadio™ used to identify or describe the company’s product – .RADIO.am & .RADIO.fm Second-Level Domain

 

ALWAYS USE BRS MEDIA, INC. MARKS AS PROPER ADJECTIVES
A trademark is an adjective and should not be used as a verb or noun or in the possessive or plural forms. Every BRS Media, Inc. Mark has a “product descriptor” (i.e. a noun) that follows the trademark.

DO NOT ALTER BRS MEDIA, INC. MARKS OR LOGOS
When using a BRS Media, Inc. Mark, never vary the spelling, add or delete hyphens, make one word two, or use a possessive or plural form of the BRS Media, Inc. Mark. When using a BRS Media, Inc. logo, never modify the design, add or delete any words, change any colors or proportions.

DO NOT ABBREVIATE A BRS MEDIA, INC. MARK TO CREATE AN ACRONYM

FM instead of dotFM®
dot instead of dotFM®

BRS MEDIA, INC. LOGOS
The BRS Media, Inc. logos must be used as a stand-alone icon to connote origination of BRS Media, Inc., without other logos and trademarks associated with it. Only BRS Media, Inc. products and services may be used in conjunction with the BRS Media, Inc. logos.

BRS MEDIA, INC. PRODUCT NAMES
No third party logo or mark can be used in conjunction with the BRS Media, Inc. Marks for BRS Media, Inc. product names except to connote that BRS Media, Inc. technology is included with another product or mark. In other words, do not combine the BRS Media, Inc. Marks with third party trademarks.

The BRS Media, Inc. Marks and Logos may not be used as part of the product name for any third party product.

Wherever a BRS Media, Inc. Mark or Logo appears with another company trademark or logo, the BRS Media, Inc. Mark or Logo must be at least as large as the trademark or logo of the other company.

USING FOOTNOTES FOR CORRECT ATTRIBUTION
It is BRS Media, Inc.’s policy to attribute BRS Media Mark and Logo use by placing the information in a footnote as follows.

Example:
“_____ are either registered trademarks or trademarks of BRS Media, Inc.”

There is no “boilerplate” footnote. The blank space should be a list of all BRS Media, Inc. Marks and Logos that appear in that particular piece. If all BRS Media, Inc. Marks and Logos are registered trademarks, then the footnote should indicate as such. Footnotes should always be complete sentences, and ordinarily appear on the copyright page, on the last page of the material.

Example:
dotFM is a registered trademark of BRS Media, Inc.

POWER POINT AND OTHER PRESENTATIONS
BRS Media, Inc. Marks and Logos, should always be attributed with the proper symbol and footnoted on all presentations that are displayed to the public (sales, trade shows etc). If a presentation is used internally, the BRS Media, Inc. Marks and Logos should be attributed but need not be footnoted.

THIRD PARTY LICENSORS
Some BRS Media, Inc. products include technology used under license from third party licensors. You may not use any such third party trademark without express permission from the owner.

RESERVATION OF RIGHTS
BRS Media Inc. is the owner of all right, title, and interest in the BRS Media, Inc. Marks and Logos. No person or entity may reproduce or use (or authorize the reproduction or use of) the BRS Media, Inc. Marks or Logos in any manner other than expressly authorized by BRS Media, Inc. Unauthorized use of BRS Media, Inc. Marks or Logos is strictly prohibited.
BRS Media, Inc. may, at its sole discretion, modify the BRS Media, Inc. Marks or Logos at any time. Please refer to the BRS Media, Inc. Mark Chart periodically to ensure your compliance. In order to assure compliance and quality of control, BRS Media Inc. may request that you provide samples of any marketing, advertising, or other material that includes the BRS Media, Inc. Marks or Logos.
